TERMS AND CONDITIONS

These Terms and Conditions (“Agreement”) are a legally binding agreement between the user (“User” or “you”) of the GENIUS MARKET Services (“we” or “us”) as described herein.

If you do not agree to any of the terms of this agreement, you may not proceed with the registration process or use the service.

SERVICES

The “Services” consist of a set of tools for advertising strategies, branding, digital advertising, growth strategies, press releases, video making and editing, social media, web design, image production and editing. Among other things, the service allows users to (a) conduct Internet advertising campaigns, (b) obtain information about their ongoing advertising campaigns, (c) generate growth strategies for their company, and (d) access various digital resources that are essential for the projection of a company’s brand.

Variety.

Regardless of whether or not written notice is given to you in advance, we reserve the right to change the terms or specifications of any service at our sole discretion by replacing it with the text of this agreement or the paid subscription plan description. on the website or notifying you in writing. Unless otherwise stated in the change notice, any change will be effective immediately. If you cannot accept any change, your only recourse is to terminate your relationship with GENIUS MARKET. After issuance of a change notice, your continued use of the service will constitute acceptance of the revised binding agreement.

Variety.

The right to use the service.

GENIUS MARKET hereby authorizes you to use the Service and the Website only in the manner specified in this Agreement and on the Website. If there is a conflict between the terms of this agreement and the website, the terms of this agreement shall prevail. Except as stated in this agreement, any use of the service or violation of any provision of this agreement will be subject to our sole discretion to suspend or revoke your privileges.

Suspension or Termination of Services.

Third Party Services.

We reserve the right to use third party service providers when we provide all or part of the Services, including but not limited to hosting providers, payment processing services, information and communication services, analytics services, Internet advertising platforms, advertising service providers and platforms. When a third party provides any of the above services, you may be subject to the third party’s terms and conditions. We are not responsible for services provided by third parties.

REGISTRATION AND ACCOUNT

Use of the service.

You may use the service as a registered or unregistered user. However, if you are not of legal age to enter into a contract within your jurisdiction, or if you do not have the right to accept this agreement, you may not use the service as a registered or unregistered user. If you are under 18, do not attempt to register for the service or send us any information about yourself, including your name, address, telephone number or email address. If we learn that we have collected personal information from anyone under the age of 18 without verifying parental consent, we will delete that information as soon as possible. Compared to using the service as a visitor (unregistered), registering as a user may provide you with the following additional benefits: monitor marketing activities and view request history.

Acceptance.

Use of the service means that you accept the terms of this agreement and fully authorize us to follow our privacy policy for obtaining, processing, storing, using and transmitting your personal data, which is an integral part of this agreement.

User Representation.

By using the Service, you represent and warrant that (a) all registration information you submit is true and accurate; (b) you maintain the accuracy of such information; (c) you are at least 18 years of age and have the capacity and authority to enter into This Agreement; and (d) your use of the Service does not violate any applicable law or regulation.

User Responsibilities.

You are responsible for all of the following behaviors when using the Service:

-Maintaining the security of user accounts and all activities that occur on user accounts;

-Maintaining accurate account information at all times, including valid email addresses and billing information, and updating such information as necessary;

-Obtaining access to the service, and such access may involve charges from third parties (such as Internet service providers or airtime charges)

-Obtain and maintain all equipment necessary to access the service.

Prohibited Uses.

You are expressly prohibited from using the service in any of the following ways or for any of the following purposes:

-No unlawful purpose. You may not use the service for any illegal or unauthorized purpose, including use in any manner that violates copyright or other applicable laws.

-No tampering. You may not use the service in a manner that is detrimental to the operation of the service or the access or use of the service by others. You will not upload or propagate viruses, worms or other destructive code. The restrictions in this section apply to any purpose that interferes or attempts to interfere with the normal operation of the service, including hacking, deleting, enhancing or changing the service.

Permission Required.

You may not, without our prior written permission and, for lease, resale and sublicensing only, except as specifically permitted in your paid subscription plan, (i) copy, distribute (including by framing any of the Services on any website) website), modify, enhance, translate, reproduce, sell, resell, sublicense, rent, lease or attempt to exploit the Services or any data resulting therefrom; (ii) decompile, disassemble, reverse engineer or otherwise attempt to discover the source code; (iii) make derivative works of the Services; (iv) remove, obscure or alter any copyright, trademark or other proprietary rights notices affixed to or contained in or accessed in conjunction with or through the website or the Services; (v) modify another website so as to falsely imply that it is associated with the Services, GENIUS MARKET or any other GENIUS MARKET product or service; or (vi) make the website or the Services, or any part thereof, available to others in a service bureau or subcontracting arrangement or for any other commercial use by a third party for time sharing, data processing or other use.

Cancellation.

You may delete your user account at any time. Please note that by doing so, all data and information stored on GENIUS MARKET’s servers will be deleted and GENIUS MARKET shall have no liability for any such loss of data or information. All service fees incurred prior to termination of registration shall be due and payable, until paid in full, notwithstanding such termination.

Termination by GENIUS MARKET.

GENIUS MARKET reserves the right to terminate any user account for abusive or fraudulent activity, for breach of this Agreement or for any other reason in its sole discretion.

FEES AND SETTLEMENTS

Service Fees.

For paid services, you will be charged the fees indicated in the applicable section of the GENIUS MARKET website or as offered on the website for a particular subscription plan (the “Fees”). Fees listed on our Web site are in U.S. dollars. The Fees, unless explicitly displayed during the subscription plan purchase process and after confirmation of the subscription plan, do not include value added tax or any other additional taxes, charges or fees that may be imposed in connection with all payments made or due hereunder. and shall, if applicable, be borne by the User, recorded and properly disclosed.

Change of fees.

We may change the price and/or introduce new additional fees in the price at our sole discretion, and give User thirty (30) days prior written notice. Notwithstanding the foregoing provisions, if (a) the service or rate of our third party service provider changes, we may increase the rate immediately and at the same time notify; (b) changes in service at User’s request; (c) delays and/or other problems caused by User’s violation of User’s obligations or by requiring User to delay work for any reason.

Payment.

The fee shall be payable in advance one month or one year in advance, or as prepaid on the Website for a specific subscription plan, at User’s option, by credit card or other payment methods accepted on the Website. All prepayment amounts and service plans will be reflected in the user’s account. Bank charges will be borne entirely by the user.

Termination

Right to Withdraw.

If GENIUS MARKET terminates this agreement, either party may, at any time, have the sole discretion to notify the other party in writing to terminate this agreement. For paid service users, notice must be sent at least 30 days prior to the date of termination.

Effect of Termination. Upon termination of this agreement, all rights of affected users to use this website or service will terminate immediately.

 Refund policy.

We guarantee full satisfaction or refund.

We will provide the purchased service to your satisfaction. If you have not received it correctly or completely, we invite you to let us know which is the missing supplement is, or in your case, we will refund the corresponding economic ratio.

Our clients have up to 60 days to communicate any clarification or disagreement regarding the contracted services.

This period does not violate the service guarantee stipulated in the contract, which is 30 days.

All our employees are fully trained to clarify and / or solve your operational problems.

If you are not satisfied, our portal can issue a refund immediately.
